1250.4(f) Leave to File Amicus Curiae Brief. A person or entity who is
not a party to an appeal or proceeding may make a motion to serve and file
an amicus curiae brief. An affidavit or affirmation in support of the motion
shall briefly set forth the issues to be briefed and the movant's interest
in the issues, and shall include such number of copies of the proposed brief
as the court requires. The proposed brief may not duplicate arguments made
by a party to the appeal or proceeding. Unless permitted by the court, a
person or entity granted permission to file an amicus curiae brief shall not
be entitled to oral argument.
850.4(d) Leave to File Amicus Curiae Brief.
(1) A motion for permission to serve and file an amicus curiae brief, made
pursuant to 1250.4 (f) of the Practice Rules of the Appellate Division,
shall include one original, five hard copies and one digital copy of the
proposed brief with proof of service of one hard copy of the brief upon each
other party to the appeal or proceeding. (2) Unless otherwise directed by
the Court, a motion for permission to serve and file an amicus curiae brief
shall be noticed for a return date no later than 45 days prior to the first
day of the term of Court on which the argument or submission of the cause is
scheduled.
